The Agricultural Marketing Service (AMS) has requested that Customs
collect a fee for imported dairy products.
Class Code 110 will be used to report the Dairy [sic].
The Dairy Fee is required effective with duty / fee computation date of 08/01/2011. The following CATAIR references define how the system determines the
duty/fee computations date:
EI (ENTRY SUMMARY) RECORD IDENITIFIER 10, INPUT, NOTE 3
EI (ENTRY SUMMARY) RECORD IDENTIFIER 20, INPUT, NOTE 2
EI (ENTRY SUMMARY) RECORD IDENTIFIER 30, INPUT, NOTE 6.
Modifications to the QR application (daily statements) to display the
dairy fee information include changes to record identifier QC (output) and record
identifiers GG and GL.

Information regarding the Dairy Fee can be found in the Federal Register,
volume 76, no. 53 which was published on March 18, 2011. The Federal Register notice
indicates that the assessment will based on the cow’s milk solids content of
the imported product at a rate of $0.01327 per kilogram of cow’s milk solids.
The Federal
Register lists the tariff numbers that are subject to the dairy fee
assessment.
The tariff numbers subject to the Dairy Fee assessment will be updated
in the near future with a new unit of measure indicating ‘ckg’. The ‘ckg’ unit
of measure will indicate the cow’s milk solids weight in kilograms . The dairy
fee assessment will equal the assessment of $0.01327 times the reported amount
indicated in the ‘ckg’ unit of measure field.
The Federal
Register notice lists all the tariff numbers subject to the Dairy
Fee assessment. Seven of the tariff numbers listed in the Federal Register
notice subject to the dairy fee assessment will not have the ‘ckg’ unit of
measure associated with the tariff number. The tariff numbers that do not have
a ‘ckg’ unit of measure field are the following:

The trade will be responsible for computing the proper Dairy Fee
assessment of $0.01327 times the amount of cow’s milk solids content in
kilograms that should be reported for the above seven tariff numbers.
