CBP Withdraws Proposal for Uniform Rules of Origin for Imported Merchandise

U.S. Customs and Border Protection has withdrawn a July 2008 proposal to establish uniform rules governing determinations of the country of origin of imported merchandise. CBP has, however, issued a final rule revising the country of origin rules applicable to pipe fittings and flanges, greeting cards, glass optical fiber, rice preparations and certain textile and apparel products.

CBP’s proposed rule would have extended the application of the rules of origin codified in 19 CFR part 102 to all country of origin determinations made under the customs and related laws as well as the navigation laws of the United States. CBP said at the time that it believed this step would result in determinations that are more objective, transparent and predictable and would facilitate the exercise of reasonable care by U.S. importers with respect to their obligations regarding the identification of the proper country of origin of imported merchandise.

However, 42 commenters opposed this proposal, and as a result CBP is withdrawing it. No discussion of the opposing comments or CBP’s response to them is included in this final rule. Read more here.
